Terms of Service

These are the terms you agree to when you use Vyavsay AI, operated by Devity, a sole proprietorship based in Bangalore, India, owned and run by Abhishek Thakur ("we", "us"). If you do not agree with them, please do not use the service.

They are written to be read. Where something matters, it is in bold rather than buried.

What Vyavsay AI is

Vyavsay AI is an assistant for small business owners in India. You can ask it questions, and it can research and write reports on funding options, compliance obligations, market demand, and business ideas. It searches public sources and cites what it finds.

It is an information service, and nothing more. It is not a lender, not a broker, not a government portal, not an agent of any authority, and not a substitute for a professional.

What it is not, and cannot be relied on as

This is the most important section in this document, so it is the plainest.

Nothing Vyavsay AI produces is legal, tax, financial, or investment advice. It is generated by an AI model from sources it found on the public web. Those sources can be incomplete, out of date, or wrong, and the model can misread them.

  • Verify before you act. Every figure, deadline, eligibility rule, and fee should be confirmed with the issuing authority, the lender, or the official portal before you rely on it. Each report says this too, and lists the sources so you can.
  • No eligibility is decided here. A report saying you appear to qualify for a scheme is not an approval, a sanction, a quote, or a promise from anyone. Only the scheme or lender decides that.
  • No compliance certificate. A compliance report is not a certificate, a filing, or proof of anything. Thresholds and due dates change, and your specific facts may change what applies. Confirm with a chartered accountant or company secretary.
  • Estimates are arithmetic, not forecasts. Where a report projects costs, revenue, or a break-even, it is illustrative and marked as such. It is not a prediction of what your business will do.
  • Decisions are yours. If you register a business, sign a lease, take on debt, give up equity, or commit capital, you do so on your own judgement and at your own risk.

Be especially careful with money. Borrow only from RBI-regulated lenders. Anyone promising guaranteed approval, no documentation, or a fee before sanction should be treated as a fraud risk, whatever a report may have said about a scheme.

Your account

You need an account, and a confirmed email address, to use the assistant. You are responsible for keeping your sign-in details to yourself and for what happens under your account.

You must be old enough to enter a contract under Indian law, and if you are using Vyavsay AI on behalf of a business, you must be authorised to do so.

The quality of what you get back depends on what you tell it. If the business details you give are wrong, the answers built on them will be wrong too.

Fair use

Researched reports cost real money to produce — each one is several web searches and several model calls — so there are limits on how many you can run per hour and per day. The app shows you what you have left. Limits may change as we learn what normal use looks like.

Please do not:

  • Use automated means to send requests, or work around the limits.
  • Resell the service, or pass its output off as your own professional advice to clients.
  • Use it to do anything unlawful, or to seek help with evading tax or regulation.
  • Attempt to extract the underlying prompts, or to make the model behave outside what the service is for.
  • Upload other people's personal information that you have no right to share.

Your content, and ours

What you write stays yours. Your messages and your business details belong to you. We store them so the service works — so your conversations are still there when you come back, and so you do not have to repeat your turnover every time. What we do with them is set out in the Privacy Policy, which is part of these terms.

The reports you generate are yours to use. Keep them, print them, and take them to your accountant or your bank. We ask only that you do not present them as professional advice from us, or strip the sources and caveats off them before passing them on.

Reports written for the public market snapshot pages are published on this site and readable by anyone, including by people who never signed in. Those pages are about a city and a line of business — never about your business or your figures.

The service itself — the software, the design, the name, and the way reports are put together — remains ours.

Availability

We will try to keep the service running and useful, but we do not promise that it will always be available, uninterrupted, or free of errors. We may change features, add or tighten limits, or stop offering the service. If we plan to shut it down, we will give reasonable notice so you can take your data with you.

Vyavsay AI depends on third parties, including Google Cloud and Google's AI models. An outage or change on their side can affect it.

Ending it

You can stop using Vyavsay AI at any time, and you can ask us to delete your account and your data — see the Privacy Policy for how.

We may suspend or close an account that breaks these terms, that is being used to abuse the service, or where we are required to by law. Where it is reasonable to, we will tell you why.

Liability

The service is provided as is, without warranties of any kind, express or implied, including as to accuracy, completeness, or fitness for a particular purpose.

To the fullest extent Indian law allows, we are not liable for indirect or consequential loss, or for lost profits, lost business, lost savings, or lost opportunity — including where these follow from a figure, deadline, or eligibility statement in a report turning out to be wrong.

Nothing in these terms limits any liability that cannot lawfully be limited, including for fraud, or for death or personal injury caused by negligence.

Where the service has been paid for, our total liability is limited to what you paid us in the twelve months before the claim. Where it has been provided free of charge, no fee has been paid, and our liability is limited accordingly.

Changes to these terms

We may update these terms. The date at the top says when they last changed. If a change materially reduces your rights, we will make a reasonable effort to tell you rather than relying on you noticing. Continuing to use the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of India, and the courts of Bangalore, Karnataka have exclusive jurisdiction over any dispute arising from them.
